A judge said the most serious charge against Fabian Gonzales will stand. Gonzales is accused of playing a role in the death of 10-year-old Victoria Martens in August 2016. There is also no word on a possible plea deal for another suspect, Jessica Kelley.
Prosecutors in the Victoria Martens case will move forward with child abuse resulting in death charges against Gonzales.
“The judge said, ‘anyway, I’m going to let the jury hear this charge, I’m going to let the jury decide,’ so he did not dismiss the first child-abuse charges against Fabian Gonzales,” said KOAT legal expert John Day.
